What California Law Says About ICE on Campus

California has strengthened protections for students and families through a series of laws, with new requirements taking effect January 1, 2026. School districts, county offices of education, and charter schools were required to adopt updated policies reflecting these protections by March 1, 2026.

  • Immigration agents cannot enter nonpublic areas of a school, such as classrooms and offices, without a valid judicial warrant (i.e., signed by a judge) or court order.

  • School staff cannot share student information, including immigration status or education records, with ICE unless a valid judicial warrant is presented.

  • Schools must notify students and families of their rights and notify the school community if ICE is on or near campus.

  • If an immigration officer requests access to a school site, staff are directed to refer them to school administration, who must contact the superintendent and district legal counsel.

California cannot block federal immigration enforcement outright, but state law limits how much schools are required to cooperate with it.
